Target Reaches $18.5 Million Dollar Settlement in Data Breach with States<\/h1>\n

It seems as though we have been writing about this case for a lifetime. \u00a0Target Corporation\u2019s\u00a0data breach saga<\/a>\u00a0came one step closer to a conclusion this week.\u00a0 On Tuesday,\u00a0Target reached an $18.5 million settlement<\/a>\u00a0with 47 states and the District of Columbia to resolve the states\u2019 investigation into the company\u2019s 2013 data breach. \u00a0 Alabama, Wisconsin, and Wyoming were not part of the settlement.<\/span><\/p>\n

Target\u2019s multi-million dollar breach response began on December 19, 2013 when\u00a0Target announced<\/a>\u00a0that it had suffered a data breach that affected more than 41 million customer payment card accounts and exposed contact information for more than 60 million customers. \u00a0You know the story from there.<\/p>\n

Target\u2019s $18.5 million\u00a0settlement<\/a>\u00a0\u2014 filed in California state court \u2014 with the 47 states \u00a0and the District of Columbia is the largest multistate data breach settlement ever reached.\u00a0 The terms of the settlement\u00a0\u2013 in addition to the $18.5 million financial penalty \u2013 include requirements for Target to employ an executive to manage a comprehensive information security program and advise the company\u2019s chief executive and board of directors.\u00a0 Target must also hire an independent third party to do a comprehensive security assessment.\u00a0 Target also has to add numerous cybersecurity measures to its systems such as encrypting payment card information, segmenting its cardholder data from the rest of its computer network, and implementing password rotation policies and two-factor authentication for certain accounts.<\/p>\n

In\u00a0announcing the settlement<\/a>, California\u2019s Attorney General Xavier Becerra emphasized his expectation that companies will provide adequate data security for their customers and that California will pursue companies that do not:\u00a0 \u201cThis should send a strong message to other companies: you are responsible for protecting your customers\u2019 personal information.\u00a0 Not just sometimes \u2013 always.\u00a0 As our state\u2019s chief law enforcer, it\u2019s my job to give Californians the confidence to know that I\u2019ve got their back.\u201d\u00a0 This sentiment was echoed by Illinois Attorney General Lisa Madigan who\u00a0stated<\/a>\u00a0that the \u201csettlement with Target establishes industry standards for companies that process payment cards and maintain secure information about their customers.\u201d<\/p>\n

In all, according to\u00a0Target Corporation\u2019s most recent Form 10-K<\/a>, through the end of 2016 Target had incurred $292 million of cumulative expenses related to the data breach, which after receipt of $90 million in insurance proceeds, resulted in total net expenses to Target from 2013-2016 of about $202 million.\u00a0 This settlement pushes the total cost to Target of the data breach to over $220 million.\u00a0 In addition, a\u00a0multi-district consumer class action remains pending<\/a>.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
